What Is The Law Regarding Harassing Telephone Calls?
Congress has enacted the Telephone Consumer Practices Act or TCPA. This law holds the following:
1. Pre-recorded messages or artificial voices, robo-calls, or they are coming from machines or robots, to your cell phone are illegal without your written permission.
2. Pre-recorded messages or artificial voices, robo-calls, to your home phone or land line are also illegal.
3. Called before: 8:00 am and after 9:00 pm are illegal.
4. Calls made by auto-dialers or predictive-dialers, often used by debt collectors to cell phones without your express written consent or electronic consent are illegal.
5. Unsolicited ads sent to your fax machine without your permission may be illegal.
6. Spam texts to your cell phone are illegal.
What extra steps can you take to stop harassing phone calls?
Let’s suppose that you just don’t want to write any letters or talk or take any phone calls but you would like the calls to go away; what can you do?
You can register your cell phone and home phone on the national do-not-call registry. You can find the registry at http://www.donotcall.gov/
And let’s say that you don’t have the Internet or don’t want don’t want to bother trying to navigate the Internet, then simple call 1-888-382-1222 which is a toll-free number for the Federal Trade Commission and where you can register your contact phone numbers with.
After your phone number is registered, businesses have 31 days to remove your contact numbers from their call list. You can even request that anyone who calls you to remove your phone number from their call list which would be valid for 5 years.
What’s the penalty for harassing or robo-calls? $500.00 to $1500.00 per call.
I just want to point out that we have information as to how to stop unsolicited junk mail and what steps you must take and that information is available free to you and can be access through your brochure (contact us to discuss).
In conclusion
You have rights under the law to stop harassing phone calls but you have to have the time and the patience to assert those rights, and the calls will go away. If the calls don’t go away, we’re here to make certain that they will stop. After we review the facts of which you’ve gathered, and if we determine that you have a case then we will be willing on a contingent fee basis to bring lawsuit against these violators. A contingent fee basis means if we don’t collect any money from the case you owe us nothing.
So you have everything to gain and nothing to lose by taking the time and the effort to be your own attorney general and assert your rights under the law, to gather the evidence, and to present it for consideration. We’re here to help you and I’m positive we can help people like we’ve helped many other people in the past.
